LOCAL DEVELOPMENT PLAN (LDP)
Intention to Adopt Plan
The West Lothian Local Development Plan Proposed Plan was submitted to the Scottish Government Planning & Environmental Appeals Division (DPEA) on 28 October 2016 to examine the unresolved representations to the Plan.
The principal Report of Examination was issued on 11 December 2017 (augmented with an additional Report of Examination dealing with a single site issue issued on 8 January 2018). These reports, which detail the Reporters’ conclusions and recommendations for each of the issues arising from the unresolved representations can be viewed at:

The recommendations contained in Examination Reports are largely binding on planning authorities and they may only depart from the recommendations in very specific defined circumstances. These are set out in Regulation 2 of the Town and Country Planning (Grounds for declining to follow recommendations) (Scotland) Regulations 2009 and Section 19(11) of the Act.
At a meeting of the Council Executive on 22 March 2018, West Lothian Council resolved to accept all of the modifications recommended in the Report of Examination, and, furthermore, agreed to adopt the Local Development Plan (as modified). The Plan, in the form that the council propose to adopt and the modifications made to the Proposed Plan can be viewed on the West Lothian Council website at: www.westlothian.gov.uk/postexaminationmodifications
It can also be inspected at West Lothian Civic Centre, Howden South Road, Livingston, EH54 6FF (Monday to Thursday 8.30am to 5.00pm and on a Friday from 8.30am to 4.00pm) and at all of the council’s public libraries during their normal opening hours.
Following the Council Executive’s decision the Plan is to be submitted to Scottish Ministers for consideration and 28 days after this the council may adopt the plan unless expressly directed not to by the Scottish Ministers.
